Terms of Use

1. The agreement

These Terms of Use ("Terms") are an agreement between you and MOZKAN ("we", "us"), the developer of DÉJÀ ME: Echo Army ("the game"). By downloading or playing the game you accept these Terms and our Privacy Policy. If you don't agree, please don't use the game.

These Terms add to Apple's Licensed Application End User License Agreement ("Apple EULA"). Where they conflict, these Terms apply to the extent the Apple EULA allows. If you are under the age of majority where you live, a parent or guardian must accept these Terms for you.

2. Your license

We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the game on Apple devices you own or control, for your own non-commercial entertainment, as allowed by the Apple EULA and these Terms. You may share screenshots and videos of your own play, including on monetized channels, as long as you don't present them as official content.

3. Accounts and progress

• The game doesn't have its own accounts. Your progress syncs through your iCloud account, achievements and leaderboards use Game Center, and the Echo Arena uses a random player id stored in your device's Keychain.
• You are responsible for your devices and your Apple Account. If you lose access to them, we may not be able to recover your progress.
• We work hard to keep progress safe, but we can't guarantee it won't be lost, for example if iCloud is turned off, a device is reset or data is corrupted. Purchased looks and passes can be restored from the Shop with Restore Purchases.

4. Virtual items

The game contains virtual currencies and items: diamonds, stars, weapons, upgrades, pilot skins, Core themes, Season XP and Echo Pass rewards ("Virtual Items").

• Virtual Items are a license to use content in the game, not property. You don't own them, and they have no monetary value.
• They can't be exchanged for real money, goods or anything of value, and they can't be sold, traded, gifted or transferred outside the game. We don't recognize any such transfer.
• Diamonds can be earned by playing and are also sold in packs. Once spent, they're used up.
• We may change how Virtual Items work (for example rebalance prices or effects) to keep the game fair and fun. We won't remove a purchased look or pass without a reason permitted by these Terms or by law.

5. Purchases and refunds

• All purchases are made through Apple's App Store and are subject to Apple's terms. Prices are shown in the game in your local currency, as provided by Apple.
• Diamond packs are consumable and are delivered to your save immediately. Looks, starter packs and Echo Passes are one-time purchases you can restore. There are no subscriptions, and nothing renews automatically.
• Except where the law requires otherwise, purchases are final once delivered. Refunds are handled by Apple at reportaproblem.apple.com. When Apple refunds a purchase, the related items, or the equivalent diamonds if they were already spent, may be removed from your save.
• If you are a consumer in the EU, the UK or another region with a right of withdrawal for digital content, you agree that delivery starts immediately when you buy, and you acknowledge that your right of withdrawal ends once the content is delivered, to the extent your law allows.
• If something you bought didn't arrive, tap Restore Purchases in the Shop or contact us with the date and item, and we'll make it right.

6. Seasons and the Echo Pass

• The game runs in seasons of about four weeks. Playing earns Season XP that unlocks rewards on a free track. The optional Echo Pass and Echo Pass+ add a premium track for that one season.
• A pass applies only to the season it's sold for and does not carry over. Rewards you reached but didn't claim are paid out automatically when the season ends.
• We may move a season's dates, or add events and limited-time offers. If a season is cut short through our fault, we'll give pass owners a fair replacement or help with a refund through Apple.

7. Echo Arena conduct

The Echo Arena puts you in matches with real people. Keep it fun for everyone:

• Pilot names must not be offensive, hateful, sexual, impersonate someone else or contain personal information or advertising. We may rename or reset names that break this rule.
• Don't deliberately lose, trade wins, play on several accounts to boost a rating, or leave matches to manipulate results. Leaving a ranked match counts as a loss.
• Don't use modified clients, bots, scripts, macros or any tool that gives an unfair advantage or interferes with other players' connections.
• Ratings, leagues and leaderboards may be reset at the start of a season or corrected if we find abuse.
• Online play depends on servers and networks that may be unavailable at times. Matches can be interrupted, and a match that can't be confirmed may not be rated.

8. What you may not do

• Copy, modify, reverse engineer, decompile or create derivative works of the game, except where the law expressly allows it.
• Cheat, exploit bugs, tamper with save data or purchases, or obtain Virtual Items in ways the game doesn't intend. If you find a bug, please report it to us.
• Attack, overload or probe our servers, or try to access data that isn't yours.
• Use the game for any unlawful purpose, or harass, threaten or harm other players.
• Sell, rent or commercially exploit the game or accounts.

9. Changes to the game

The game is a live service. We may update, add, change or remove features, levels, modes, balance and content, and we may need you to install an update to keep playing online. We may eventually stop operating online features. If we do, we'll give reasonable notice in the game where we can. Offline modes will keep working with the version you have.

10. Ownership

The game and everything in it (code, art, music, sound, characters, names and the DÉJÀ ME brand) belong to us or our licensors and are protected by copyright and other laws. Some sound effects and fonts are used under open licenses (for example CC0 and the SIL Open Font License). Feedback and ideas you send us may be used freely, without obligation to you.

11. Suspension and termination

You can stop playing at any time by deleting the app. We may suspend or end your access to online features, or remove Virtual Items obtained through cheating, fraud or refund abuse, if you seriously or repeatedly break these Terms. Where reasonable, we'll tell you why and give you a chance to respond. Sections 4, 10 and 12–16 continue to apply after termination.

12. Disclaimers

We make the game with care, but it is provided "as is" and "as available". To the extent the law allows, we don't promise that it will be uninterrupted, error-free or always available, or that it will meet every expectation. Nothing here limits warranties or rights that can't be excluded under the consumer law of your country.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or goodwill arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid us for the game in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

14. Apple

You and we agree that these Terms are between you and us only, not with Apple. Apple is not responsible for the game or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it (including product liability, legal compliance or intellectual property claims). If the game fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

15. Governing law and disputes

These Terms are governed by the laws that apply at our place of business, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts. Before taking any formal step, please contact us. Most problems can be solved quickly by email.

16. Changes to these terms

We may update these Terms from time to time, for example when we add features. We'll change the date at the top and, for significant changes, let you know in the game or on this site before they take effect. If you keep playing after a change takes effect, you accept the new Terms.
